ClimateGuard reports are forward-looking estimates generated by combining published climate datasets with AI-assisted analysis. They are not financial, legal, engineering, or insurance advice, and they are not a guarantee of any future outcome. Use ClimateGuard outputs as one input alongside qualified professional judgement; do not rely on them in isolation for any material decision.
1.Who these Terms apply to
These Terms of Service ("Terms") are a binding agreement between you (or the organisation you represent) and ClimateGuard ("we", "us"), currently operating as an unincorporated business based in the Philippines, governing your access to and use of the climate-risk reporting platform at climate-guard.io (the "Platform"). By creating an account, requesting trial access, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy.
2.What the Platform does
ClimateGuard produces IFRS S2-aligned climate-risk reports for individual assets and portfolios. Reports cover physical climate hazards (flood, wildfire, heat stress, sea level rise, storm, drought, tornado), natural / geological hazards (earthquake, volcano, landslide), and transition-risk categories (policy, technology, market, reputational). Reports are generated using publicly available climate datasets (e.g. IPCC AR6, JRC, GESLA, WorldClim, NASA, USGS, IEA pathways) combined with AI-assisted narrative drafting.
3.Your account
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must immediately notify us at admin@climate-guard.io of any unauthorised access. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Platform.
4.Acceptable use
You agree NOT to:
- Use the Platform for any unlawful purpose, or in violation of any applicable export-control / sanctions law;
- Reverse-engineer, decompile, scrape, or attempt to extract our source code, models, or proprietary methodology;
- Resell, sublicense, or expose Platform output as a stand-alone service without a written commercial arrangement;
- Misrepresent ClimateGuard output as your own original analysis, or remove ClimateGuard attribution from a report you redistribute;
- Interfere with, overload, or attempt to compromise the security of the Platform;
- Submit inputs designed to elicit harmful, defamatory, or unlawful content via our AI components.
5.Reports — methodology disclaimer (important)
Our reports use forward-looking climate science that is inherently uncertain. Specifically:
- Scenarios (e.g. IPCC AR6 SSP1-2.6 / SSP2-4.5 / SSP5-8.5) are possible futures, not predictions. Realised climate may differ materially.
- Asset-level risk scores combine global / regional datasets — they are best-effort approximations and do not substitute for site-specific engineering, geotechnical, or hydrological assessment.
- Financial impact figures (Expected Annual Loss, PML, VaR, NPV) are model outputs based on the inputs you provide and standard methodology assumptions documented in the report appendix.
- Reports do not assess every conceivable hazard. Specifically excluded unless explicitly added as an enterprise add-on: nuclear, terrorism, pandemic, geopolitical conflict, and asset-condition risks.
- AI-drafted narrative sections are reviewed by deterministic methodology rules before delivery, but may still contain phrasing artefacts. You are responsible for reviewing reports for accuracy before relying on them.
ClimateGuard reports are not investment advice, insurance advice, engineering certification, regulatory opinion, or a substitute for the judgement of a qualified professional. If your use case involves a material decision — capital allocation, divestment, lending, insurance underwriting, regulatory filing — you must obtain independent expert review.
6.Pricing & payment
Pricing for paid plans is displayed on our pricing page. Prices may change with at least 30 days' notice. Currently the Platform operates in closed beta and individual reports are credit-based; commercial billing terms will be confirmed at the point of paid plan activation, payable via a PCI-compliant processor.
7.Intellectual property
We own the Platform, the underlying methodology, the model logic, and the visual / written presentation of reports. You own the inputs you submit and the report files generated for your assets. Reports are licensed to you for internal use and disclosure to your auditors, regulators, investors, and lenders. Public redistribution requires written permission and retained "Generated by ClimateGuard" attribution.
8.Warranty disclaimer
The Platform and all reports are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Platform will be uninterrupted, error-free, or that any output will be fit for any specific decision you make.
9.Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Platform or any report, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to the Platform or these Terms will not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the event giving rise to the claim, or (b) USD 100.
10.Indemnification
You agree to indemnify and hold ClimateGuard harmless from any third-party claim arising out of (i) your misuse of the Platform, (ii) your violation of these Terms, or (iii) your redistribution of report output in violation of §7 above.
11.Term, suspension, and termination
These Terms apply for as long as your account is active. We may suspend or terminate your access for material breach of these Terms, abuse, or where required by law. You may terminate at any time by emailing admin@climate-guard.io. Sections 5, 7, 8, 9, 10, and 12 survive termination.
12.Governing law & disputes
These Terms are governed by the laws of the Philippines, without regard to its conflict-of-laws principles. Disputes will be resolved first by good-faith negotiation, and failing that, by the courts of Makati City, Philippines, except where applicable consumer-protection law grants you the right to bring an action in your home jurisdiction.
Upon incorporation, this clause will be updated to reflect the formal entity's jurisdiction. Existing customers will be notified before any material change.
13.Changes to these Terms
We may update these Terms from time to time. Material changes will be announced on this page and, where they expand your obligations or restrict your rights, communicated to your account email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
